Selection Caveat

Discussion

NPCs should hire on the basis of applicant’s qualifications to perform the duties of the position most effectively. Employers cannot discriminate in hiring based on pregnancy, sex, race, color, national origin, citizenship, physical or mental disability, religious belief, past or current membership in a military branch, and age. Federal law also prohibits employers from discriminating against applicants who have declared bankruptcy or refuse to take a polygraph examination.

Some states bar discrimination based on marital status, sexual orientation, arrest or conviction records and off-hours smoking or other legal behaviors. Take the time to become familiar with your state employment requirements.

See Workplace Statutes and Practices section for applicable statutes and regulations.
