SAMPLE POLICY FOR REVIEW AND APPROVAL OF NONPROFIT EDUCATION ACTIVITIES

THE CITY VAMC NONPROFIT EDUCATION AND TRAINING SUBCOMMITTEE

PURPOSE: To designate membership and define the responsibilities, function, and structure of the [city] VAMC Nonprofit Education and Training Subcommittee.

POLICIES: The subcommittee makes recommendations to the Medical Center Director through the Medical Center Education and Training Committee with respect to the expenditure of funds donated to [name of NPC] for the purpose of supporting medical center employee/patient education and training.

PROCEDURE(S):

Requests for review and approval of [NPC name] activities are prepared using the form (click here for a sample form) developed by the subcommittee (available on the foundation web site) and requests are submitted to [NPC name] for review and concurrence.

  • Such requests explicitly state how the proposed expenditure for an education activity meets the definition of nonprofit education and training listed below.
  • The form includes [NPC name]'s agreement to administer the proposed activity.
  • The form identifies the source of the funds that will be used to support the activity (unrestricted education funds already deposited in nonprofit, name of donor, etc.)

Supporting documentation is attached to the request. Forms must be submitted to the nonprofit no later than C.O.B the Friday before a regularly scheduled subcommittee meeting.

The subcommittee will meet on a monthly basis (3rd Wednesday at 3 PM) or more frequently at the discretion of the chairman. The subcommittee coordinator prepares the agenda prior to each meeting and prepares the minutes of each meeting. The subcommittee's recommendations are submitted through Education and Training Committee to the Chief of Staff and Associate Medical Center Director to the Medical Center Director.

NONPROFIT EDUCATION AND TRAINING ACTIVITIES

The subcommittee may recommend approval to use nonprofit funds for the following education and training activities when there is no research component involved:

  1. Educational seminars
  2. Employee education and training activities
  3. Patient education and training activities

The subcommittee bases its recommendations for proposed nonprofit education activities on applicable VA Education manual policies pertaining to conflict of interest and appropriateness to VA's education missions as well as the definition of education and training established by P.L. 111-163, Section 802-806 (Title 38, Section 7362):

For purposes of this section, the term `education and training' means the following:

(1) In the case of employees of the Veterans Health Administration, such term means work-related instruction or other learning experiences to--

(A) improve performance of current duties;

(B) assist employees in maintaining or gaining specialized proficiencies; and

(C) expand understanding of advances and changes in patient care, technology, and health care administration.

(2) In the case of veterans under the care of the Veterans Health Administration, such term means instruction or other learning experiences related to improving and maintaining the health of veterans to patients and to the families and guardians of patients.
